Court Upholds RICO Claims In PREPA Conspiracy Lawsuit

SAN JUAN, Puerto Rico – A U.S. District Judge overseeing a class-
action lawsuit against Puerto Rico Electric Power Authority (PREPA)
and the world’s largest fuel oil suppliers for perpetuating an extensive
fuel oil fraud upheld claims that defendants violated the Racketeer In-
fluenced and Corrupt Organizations Act (RICO) and denied motions
to dismiss the suit, according to Hagens Berman.

The order from Judge Jay A. Garcia-Gregory on Apr. 5, 2016 denied
motions to dismiss from the majority of the suit’s 20 defendants, allow-
ing RICO claims to continue against PREPA, Shell Oil, Petrobras, Al-
chem and various other laboratories and fuel oil suppliers.

“This order is a major victory for the nearly 1.5 million PREPA custo-
mers who were defrauded through this complex and deeply entrenched
scheme,” said Steve Berman, managing partner of Hagens Berman. “Re-
sidents and businesses were overcharged to the tune of $1 billion by the-
se corrupt, greedy organizations, and we are pleased that the court agrees
that they should be held to answer for their actions.”

In the original suit, filed Feb. 24, 2015 in the U.S. District Court for the
District of Puerto Rico, Puerto Rico residents and businesses accused PR-
EPA and 20 total defendants of perpetuating an extensive fuel oil fraud,
resulting in users of electricity in Puerto Rico being overcharged by more
than $1 billion dollars for electricity since 2002. The suit states the defen-
dants received kickbacks and payments for colluding to raise fuel oil pri-
ces that were directly passed to users of electricity, by agreeing to use non-
compliant fuel oil and falsifying lab tests.

The order from Judge Garcia-Gregory stated, “Plaintiffs’ allegations aga-
inst PREPA are extensive,” denying PREPA’s motion to dismiss on gro-
unds that it is a co-conspirator with responsibility for inflating the fuel’s
price. “Plaintiffs have successfully shown this by alleging that the three
groups of participants—the Fuel Oil Supplier Participants, the PREPA
Participants, and the Laboratory Participants—all coordinated together
for the common purpose of falsifying laboratory results to pass off Non-
compliant Fuel Oil as Compliant Fuel Oil.”

Attorneys allege that PREPA – one of the largest public power agencies
in the United States – fraudulently agreed to accept millions of barrels of
fuel oil that did not meet specifications of contracts between PREPA and
its oil suppliers, or specifications set by the EPA. PREPA accepted this non-
compliant fuel oil and the laboratories certified the fuel oil as compliant in
exchange for kickbacks and commissions from the fuel oil suppliers, accor-
ding to the complaint. PREPA served approximately 1.5 million customers
in 2012.

In recent developments in the case, plaintiffs alleged that Alchem, a labo-
ratory named in the suit’s laundry list of defendants, switched its testing
methodology to satisfy PREPA on Dec. 31, 2010 and that it used the new
testing methodology to falsify test results for every PREPA sample tested
after this date. Plaintiffs point to contrasting sample pages of Alchem’s log
book dated before the change in testing methodology and after the change,
showing the log book page before the change in testing methodology refle-
cts that every sample tested was rendered non-compliant, whereas the two
log book pages after the change show that every sample tested was deemed
compliant.

“Based on Plaintiffs’ new allegations, the Court finds that Plaintiffs have
adequately pled that Alchem committed two or more RICO predicates and
thus have alleged Alchem’s participation in a ‘pattern of racketeering acti-
vity.’”

The suit seeks to recover out-of-pocket losses, compensatory damages and
punitive damages for plaintiffs under the RICO Act and for the disgorge-
ment of profits under the common law of unjust enrichment.

Only The Young Can Save Puerto Rico

Every year hundreds of millions of dollars in public funds are allegedly stolen 
by Puerto Rico’s professional political class and government workers.  Money
 that could not only pay Puerto Rico’s debt payments but help pay off their 
staggering debt. Because of this, government services are curtailed and the 
poor continue to suffer. 

Senior Puerto Ricans have been a part of this culture of corruption for so 
long that they have no desire to change it. 

According to 2015 RICO charges, a scheme to steal one hundred million 
dollars a year in public funds from the Puerto Rico Electric Power Authority 
(PREPA) was uncovered.  The auditors that uncovered the theft were fired 
and the Directors at PREPA that supported the auditors were replaced or 
bought off. 

It is this kind of outcome that keeps middle age Puerto Ricans from speaking 
up. They fear the loss of their jobs or worse. In the meantime, government 
employees like William Rodney Clark (RICO Defendant), the Manager for the 
PREPA fuel purchase office, takes an early retirement to enjoy the alleged re-
wards associated with participating in some of the islands on-going corruption.

The Puerto Rico government has failed to provide audited financial state-
ments for two years.  There is no credible accounting firm on the globe that 
wants to be a party to these allegedly inaccurate or fraudulent government 
accounting schemes.

No, it has to be the youngest generation of Puerto Ricans that cleans us this 
mess and saves Puerto Rico.  Teenagers, young adults and college students 
are Puerto Rico’s only hope.  Maybe, just maybe they have had enough and 
want to save this beautiful island for their children.

Puerto Rico’s Government Officials Try To Save The Goose That Lays Their Golden Eggs

On November 4th, 2015 the Governor of Puerto Rico submitted the
PREPA Revitalization Plan to the Puerto Rico Legislature.  It needed
to be approved by the 12th and it was not.

The revitalization plan was written to gain approval from bond holders
and insurers for a major financial restructure of the utility's balance sheet.

It has been an open secret on the island for many years that PREPA has
been mismanaged.  The utility has been used to redirect as much as $100,
000,000 a year from the people of Puerto Rico to select government offi-
cials.

In 2010 a handful of honest PREPA Directors and employees uncovered
the scheme during a routine audit.  Enough Government Officials were in-
volved that they were able to fire the auditors, change the results of the au-
dit and cover up the on-going theft.

The PREPA Revitalization Plan will not be allowed to pass as written. The
plan gives to much control to “outsiders”.  These outsiders may prevent the
Government Officials from maintaining enough control to continue the theft
of public money and insure its continued cover-up.

The arrogance of these officials is astounding.  They make little effort to
cover-up their efforts to sustain this scheme.  Just take a close look at wh-
ich legislators are trying to water down the control provisions in the Revi-
talization Act.

How can these Government Officials afford the homes, cars, private sch-
ools and vacations they take? The answer is PREPA.  How can they expla-
in their large foreign bank accounts and impressive foreign real estate hol-
dings?  The answer, once again, is PREPA.

These individuals have had their way with PREPA for over a decade. They
believe they are untouchable.

Rest assured, the February, 2015 RICO lawsuit that was filed is paying big
dividends.  Many of the twenty defendants that have been named are rolling
over to save themselves.  It is just a matter of time before the federal prison
system plays host to a significant number of Puerto Rico Legislators.
